Compliance with Industrial Relations and Employment Obligations Strategy

The ACT Government has introduced the Compliance with Industrial Relations and Employment Obligations Strategy (Strategy). You may obtain a copy of the Strategy from the link below.

The Strategy is part of a package of ACT Government initiatives being introduced to ensure industrial relations and employment compliance best practice is part of the culture of the construction industry.

Before contractors (this includes project managers, head contractors, sub-contractors and trade contractors) will be permitted to tender for building work or be engaged to perform building work on any ACT Government site they will be required to hold a current Industrial Relations and Employment Certificate (IRE Certificate).  Contractors must maintain a current IRE Certificate while they are engaged on an ACT Government site.

The Strategy will be implemented from 1 July 2011.  It is intended that contractors will need to hold an IRE Certificate to work on ACT Government projects by 1 January 2012.  Further details regarding timing for the implementation of the Strategy will be provided to stakeholders progressively.

The implementation of the Strategy will include the following:

1.  establishment of an open registration process for Approved Auditors responsible for:

(a) assessing applications by contractors for IRE Certificates and issuing IRE Application Reports to those contractors; and

(b) conducting random Project Compliance Audits on Act Government projects as and when requested by the ACT Government.

2.  when a contractor provides the Territory with their IRE Application Report, which contains a recommendation by the Approved Auditor to issue an IRE Certificate, the Territory will consider the issue of an IRE Certificate to the contractor.
